Lost my job, AGAIN

I was dismissed after 5 months of work. I have made a case against my employer because they didn't follow the correct procedure when firing me( i.e. no warnings or a disciplinary hearing.) I did work at my best at the job, but I also did make mistakes.

At part of me is wondering if I am the one to blame for this. I was also dismissed from a similar position in Aug 2013.

I'm 31 years old. HD Gene positive. Married for a decade this year.

My left hand has started to do this strange contraction which raises my hand. Only happens about once a day. I also suffer from depression ( am on antidepressants.)

I had a cramp in my foot last week that lasted continiously over 6 hours. It was terrible.

I have an appointment with the specialist in May. Soo long to wait.

Seeing that it's two job in almost one year, brings me to the conclusion that it must be ME. Is it possible that I could suck at my job at not realise?

Sure, you could suck at your job and not know it. Same goes for me and I don't have HD. I don't know what kind of work you do, but maybe it's time to see what kind of lower stress kinds of things you can do.
Mistakes are going to happen whatever you do, whoever you are but if you are a surgeon that is a big deal. If you are a painter-mistakes can make a masterpiece.
Use this opportunity to really focus on things that you are able to do that are low stress and mistakes are not crucial to the over all business model.
I am rooting for you and hope your appointment in May helps you get this figured out!

VRE said it well. I was told a long time ago to quit dwelling on the mistake but rather learn from it an move on. I'm not saying this is your situation by any means or that it applies (at the time it did apply to me). We can be our worst critics some time. Reflect on the situation, perhaps write down the good things and then the negative. It may help.

If you can get the decision reversed on the grounds you weren't given any warnings, and if the job has a good benefit package, then the minute they take you back, immediately take a sick leave, get a doc to say this is because of hd, and you will be able to collect good benefits. I have hd too, I'm sorry to say, but if this has happened twice in the last year, and like you say, this is not the norm for you, I would suspect it is the hd. If this doesn't work out...getting your job back...another option would be to find another job with good benefits, and as soon as the benefits kick in, take your sick leave, before they have a chance to fire you. I'm sorry this is happening to you, but I think you said it best when you said you could see yourself making mistakes, I'm just sorry you didn't take sick leave while you could, good luck to you for sure

This has been a big thing for me lately. I'm a business manager , 54 and at an at my job for 18 years. I have a bad memory but do a lot to overcome with excel spreadsheets. I am very bright and have done well

The problem is that I work in a very political scenario and my newest boss, the 3rd one in 3 years, has been abusive. I did make errors recently too. I told HR and now they told me I could request accommodations. They also made it clear that they didn't have to accommodate.

Help. did you get an attorney to help. At what point did you file for disability? I have read it take 2 years. what about them deny this. Do you go to another position with less pay? What are my rights? can you go to another job without them knowing if you've been to a neurologist? I been divorced for a few years so I'm not in good financial state at this time.

Well HD People please help!!

Mare, they don't get to decide if you can get disability, your doctor does. Don't go for a lower pay job, or you wont get as much money from their benefit plan. You go to your doc, and he writes you a note that you take to them saying you need a temporary sick leave for let's say 6 weeks. During that 6 weeks you go to your neuro, he writes the company a letter saying you are no longer able to work, and you leave on permanent disability. Yes, it may take a few months for all your disability paperwork to go through, but the company has nothing to do with that, it's between your docs and your company's insurance provider. If you don't do it this way, you will find yourself not only without a job, but also without benefits

My husband had similar issue. His job said they would not accommodate him because a primary function of his job was to be able to drive, and he could no longer do so. There weren't any available positions in the company that would fit his skill set, so they put him on medical leave. At first he used a couple months of sick leave (rarely took sick time in 9 years so he had a lot to use up). The company had short term and long term disability (different from long term care) benefits. Most mid to larger companys have this in place as a benefit for employees and you're typically paid around 60 percent of your current salary, depending on the plan you're signed up for. This policy will be your lifeline as you wait for your SSDI government benefits to kick in. I think you can apply for SSDI after six months continuous out of work status and documentation from your doctor. It's the Medicare medical benefits that take two years to kick in once your SSDI has been approved. Keep in mind too that once SSDI starts, and you get months of back pay, your long term disability will expect to be paid back. At that point long term disability private company will adjust their payments to you so that your total compensation stays at 60 percent. The long term disability policy my husband's company had included a sub-contractor that assisted the employees with filing for government SSDI. After a couple of phone calls with us, they got all the necessary info from the doctor and employers, and submitted the claim on his behalf. It was quite painless for us and his claim was approved on the first try.

One other thing you might want to check since you've been with your company so long is whether or not you can stay on medical leave until you are able to retire. My husband wanted to retain his flight benefits and was a year shy of being able to retire with full benefits. Their policy allowed him to stay on medical leave up to 3 years and still be eligible for flight benefits upon retirement. Something to consider if your company has special retirement perks. P.S. Don't let the company bully you. If they try to force you out, you can reach out to EEOC (Equal Employment Op....) or ADA (American Disabilities ...), or even a local community service that has lawyers that do pro bono work. There's a cost to hiring a private lawyer, you may want to try free or less expensive avenues first. Also, read your company insurance policies yourself, don't rely on HR to tell you the whole story. Call the toll free number on the insurance policy and ask questions as well.

We don't have disability insurance, but I do have AFLAC for short term. Maybe they have people that can help me. I will be talking a plan with my doctor who supports helping me.

All good advice, also remember that besides taking any SSDI back pay, they will not only reduce your LTD payments by the amount of SSDI you receive but also any dependents whether or not they live with you or whether you receive those benefits. The insurance companies are not your friend, they do not want to pay these benefits and will get out of it any way they can...and there are many ways. Thus the benefit you have paid and your company has paid premiums on, may or may not be there for you.
